General

By purchasing products from Rotorua Community Hospice Online Store ("RCH", “RCH Store” "we", "us", "our") or using this website, the purchaser (the "Customer", "you", "your"), agrees to the following terms and conditions of sale (the "Terms").

Rotorua Community Hospice sells a range of products with the proceeds used to fund Rotorua Community Hospice. Rotorua Community Hospice is located in Rotorua, New Zealand – PO Box 1092, Rotorua 3040. The Rotorua Community Hospice Trust is registered with the Charities Commission: #CC 21602.

Product information

The RCH store sells a range of products and offers the option to donate directly to Rotorua Hospice. All products listed on the RCH store are described to the best of our abilities and the specifications reflect the information that has been provided to us. All care is taken to ensure this information is correct, but we cannot eliminate the possibility of error.

Security

RCH uses reasonable endeavours to ensure this website, and any transactions conducted on it, are secure. The website ordering system uses a third party credit card processing facility that securely encrypts your personal and financial details. We do not store any credit card details. However, you acknowledge that the security of information and payments transmitted via the Internet can never be entirely secure or error free. RCH will not be liable for any damages suffered due to failure, delay, interception or manipulation of electronic communications by third parties on any computer programmes (e.g. those used for transmission of viruses).

Payment

All purchases made on the RCH Store are made in New Zealand dollars, and inclusive of NZ Goods and Service Tax. If you choose to donate to RCH, donations of $5 or more are tax-deductible and will be receipted. Up to 33% of your donation may be claimed back as a tax rebate through the Inland Revenue Department.

All orders must be pre-paid before RCH will distribute your purchases, including any relevant shipping costs. If the card payment is declined by your issuer for any reason, we cannot hold goods against your order. We do not accept deposits or part payments for the purchase of any goods.

RCH’s available payment methods will be presented at the time of purchase. Where RCH gives the customer the choice to pay for products through bank transfer, if the Customer credits money to the incorrect bank account number, and the correct number was provided to the Customer by RCH, then RCH will not accept any responsibility for correcting payment and goods will not be dispatched by RCH until RCH has received payment in full.

Delivery

Delivery is as per the customers chosen selection during checkout. All orders with a delivery option chosen will be Parcel Post Tracked, or on occasion, hand-delivered in the Rotorua area. Deliveries (when the product is currently in stock) are sent once a week on a Tuesday to urban addresses on a 1-3 business day Parcel Post Tracked delivery service. However please allow up to 10 business days for delivery to allow for delays in postage outside of our control (please allow a further 5 business days for rural delivery).

We do not currently provide a delivery service for international orders.

Please ensure you have entered all of your delivery details correctly. We cannot be held liable for errors provided in information to us, including but not limited to incorrect address or email details. If a product is found to be misaddressed then RCH shall be responsible for the re-delivery, replacement or refunding of the product.

Pricing

Our prices quoted in our website are current, however they may vary from time to time as determined by RCH. Although we do our best to ensure prices stated on this website are accurate, errors do occur from time to time. Where a pricing error occurs (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your purchase.

Claims & Returns Policy

RCH will comply with its obligations under the Consumer Guarantees Act or any other applicable consumer protection legislation that cannot be excluded.

All purchased goods leave our premises and/or the premises of our preferred suppliers in excellent condition. Should those goods not be received by you in excellent condition, then it will be considered the responsibility of the Carrier and should be pursued directly with them. Any claim of damage to or shortfall in products received must be reported to RCH in writing or by email within 48 hours after receipt of the goods. All returns must be pre-approved by emailing us.

Once goods are dispatched, there will be strictly no refunds other than for defective merchandise. Merchandise will not be accepted as returned if it is not in its original packaging and intact.

Cancellations

RCH reserves the right to cancel orders for any reason or to cancel the purchase agreement after order confirmation, including (without limitation) where RCH believes the order to be fraudulent or constitute a mis-use of a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing. If we do cancel your order or purchase agreement, we accept no liability for any resulting damages or costs suffered by you, however we will refund the purchase price to you (where it has already been paid).

Limitation of Liability: 

RCH or the RCH Online Store shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services from RCH, even if RCH has been advised of their possibility. In no case shall RCH’s maximum liability exceed the cost of the relevant original order.
